1. คำนิยาม

เพื่อวัตถุประสงค์ในการใช้ข้อกำหนดการใช้งานฉบับนี้ ให้คำต่อไปนี้มีความหมายดังต่อไปนี้:

  1. “บัญชี” หมายถึง บัญชีส่วนบุคคลของผู้ใช้งานที่จำเป็นต้องใช้ในการเข้าถึงและใช้บริการ
  2. “ข้อกำหนดเพิ่มเติม” หมายถึง ข้อกำหนดและเงื่อนไขเพิ่มเติมใด ๆ ที่อาจใช้บังคับกับบริการ กิจกรรม งานส่งเสริมการขาย หรือโปรแกรมเฉพาะ ซึ่งอาจมีการแจ้งหรือเปิดเผยให้ผู้ใช้ทราบเป็นคราว ๆ ไป ตามที่เห็นสมควร
  3. “แอปพลิเคชัน” หมายถึง แอปพลิเคชันมือถือและเว็บไซต์ของ EVOLT ซึ่งผู้ใช้งานสามารถเข้าถึงและจัดการบริการชาร์จรถยนต์ไฟฟ้า (EV) ได้
  4. “ค่าใช้จ่าย” หมายถึง ค่าธรรมเนียม ค่าบริการ หรือค่าใช้จ่ายใด ๆ ที่ผู้ใช้อาจต้องรับผิดชอบอันเกิดจากการใช้บริการ รวมถึงแต่ไม่จำกัดเพียง ค่าบริการที่เกิดจากการให้บริการโดยผู้ให้บริการ
  5. “เครดิต” หมายถึง มูลค่าเงินที่ผู้ใช้งานเติมเข้าสู่บัญชีผู้ใช้งานในแอปพลิเคชัน เพื่อวัตถุประสงค์แต่เพียงอย่างเดียวในการซื้อสินค้า บริการ หรือฟีเจอร์ที่มีให้บริการภายในแอปพลิเคชัน
  6. “EVOLT” หมายถึง บริษัท อีโวลท์ เทคโนโลยี จำกัด ซึ่งเป็นบริษัทจำกัดที่จัดตั้งขึ้นตามกฎหมายแห่งราชอาณาจักรไทย
  7. “ผู้ให้บริการ” หมายถึง บริษัทหรือนิติบุคคลภายนอกที่ EVOLT อาจว่าจ้างให้ดำเนินการหรือให้บริการบางประการในนามของบริษัท ทั้งนี้เพื่อวัตถุประสงค์ในการให้บริการ บำรุงรักษา พัฒนา หรือสนับสนุนการให้บริการ
  8. “บริการ” หมายถึง แอปพลิเคชัน เว็บไซต์ เนื้อหา ผลิตภัณฑ์ ฟีเจอร์ เทคโนโลยี และบริการอื่นใดที่บริษัท อีโวลท์ เทคโนโลยี จำกัด ให้บริการ ทั้งที่มีอยู่ในปัจจุบัน และที่อาจมีการพัฒนาและให้บริการในอนาคต
  9. “ผู้ใช้งาน” หมายถึง บุคคลธรรมดาหรือบุคคลนิติบุคคลใด ๆ ที่เข้าถึงหรือใช้บริการ

2. ความสัมพันธ์ที่เกี่ยวข้องกับสัญญา

ข้อกำหนดการใช้งานเหล่านี้ (“ข้อกำหนด”) ใช้บังคับและควบคุมการเข้าถึงและการใช้แอปพลิเคชัน เว็บไซต์ เนื้อหา ผลิตภัณฑ์ คุณลักษณะ เทคโนโลยีและบริการต่าง ๆ ทั้งในปัจจุบันและที่จะได้พัฒนาหรือจัดให้มีขึ้นในอนาคต ที่จัดทำโดยบริษัท บริษัท อีโวลท์ เทคโนโลยี จำกัด ซึ่งเป็นบริษัทจำกัดที่จัดตั้งขึ้นภายใต้กฎหมายของประเทศไทย โดยมีสำนักงานใหญ่ตั้งอยู่ที่ บล็อก 28 อาคาร C ชั้น 2 ยูนิต C201-202 ซอยจุฬา 7 แขวงวังใหม่ เขตปทุมวัน กรุงเทพมหานคร 10330 ประเทศไทย

ข้อกำหนดนี้ใช้บังคับกับผู้ใช้งานที่พำนักอาศัยหรือดำเนินกิจการอยู่ภายในเขตอำนาจศาลของประเทศไทย

3. การรับทราบและยอมรับเงื่อนไข

โปรดอ่านข้อกำหนดเหล่านี้อย่างละเอียดก่อนเข้าถึงหรือใช้บริการ การเข้าถึงหรือการใช้บริการถือเป็นการยืนยันว่าผู้ใช้งานได้อ่าน เข้าใจ และตกลงที่จะผูกพันตามข้อกำหนดเหล่านี้ ซึ่งถือเป็นการสร้างความสัมพันธ์ทางกฎหมายในรูปแบบของสัญญาที่มีผลผูกพันระหว่างผู้ใช้งานและ EVOLT ผู้ใช้งานที่ไม่ยอมรับข้อกำหนดเหล่านี้จะไม่ได้รับอนุญาตให้เข้าถึงหรือใช้บริการ

ข้อกำหนดเหล่านี้อาจถือเป็นข้อตกลงฉบับสมบูรณ์ หรือเป็นส่วนเพิ่มเติมของข้อตกลงก่อนหน้าระหว่างผู้ใช้งานและ EVOLT ทั้งนี้ EVOLT ขอสงวนสิทธิ์ตามดุลยพินิจแต่เพียงผู้เดียวในการยกเลิกข้อกำหนดเหล่านี้ ระงับหรือยุติการให้บริการทั้งหมดหรือบางส่วน หรือจำกัดการเข้าถึงบริการของผู้ใช้งานได้ทุกเมื่อ และด้วยเหตุผลใด ๆ โดยไม่จำเป็นต้องแจ้งให้ทราบล่วงหน้า

อาจมีข้อกำหนดและเงื่อนไขเพิ่มเติมที่เกี่ยวข้องกับบริการบางประเภท กิจกรรม หรือโปรแกรมส่งเสริมการขาย ซึ่งจะมีการแจ้งให้ผู้ใช้งานทราบตามความเหมาะสม หากข้อกำหนดเหล่านี้มีความขัดแย้งกับข้อกำหนดเพิ่มเติม ข้อกำหนดเพิ่มเติมจะมีผลเหนือกว่าสำหรับบริการที่เกี่ยวข้อง
EVOLT ขอสงวนสิทธิ์ในการแก้ไขหรือปรับปรุงข้อกำหนดเหล่านี้ รวมถึงนโยบายหรือข้อกำหนดเพิ่มเติมใด ๆ ตามที่เห็นสมควร การเปลี่ยนแปลงดังกล่าวจะมีผลบังคับใช้ทันทีเมื่อมีการเผยแพร่ ผู้ใช้งานที่ยังคงเข้าถึงหรือใช้บริการหลังจากการเผยแพร่ ถือว่าตกลงยอมรับข้อกำหนดที่ได้รับการแก้ไขหรือปรับปรุงแล้ว

4. การบริการ

บริการนี้ประกอบด้วยการให้บริการสถานีชาร์จรถยนต์ไฟฟ้า (EV) และเทคโนโลยีแพลตฟอร์มที่สามารถเข้าถึงได้ผ่านแอปพลิเคชันหรือเว็บไซต์ของ EVOLT ผู้ใช้งานสามารถใช้แอปพลิเคชันเพื่อค้นหา จอง และจัดการการชาร์จรถยนต์ไฟฟ้า เริ่มต้นและปรับเปลี่ยนบริการชาร์จ ดำเนินการชำระเงิน รวมถึงคุณลักษณะและบริการต่าง ๆ ของ แอปพลิเคชันที่จะได้พัฒนาหรือจัดให้มีขึ้นในอนาคต

4.1 การให้สิทธิใช้งาน

ภายใต้เงื่อนไขของข้อกำหนดนี้ EVOLT ให้สิทธิการใช้งานแบบจำกัด ไม่ผูกขาด ไม่สามารถโอนสิทธิ และสามารถเพิกถอนได้แก่ผู้ใช้งาน เพื่อ:

  1. เข้าถึงและใช้แอปพลิเคชันบนอุปกรณ์ส่วนตัวสำหรับวัตถุประสงค์ในการใช้บริการเท่านั้น; และ
  2. เข้าถึงและใช้เนื้อหา ข้อมูล และอุปกรณ์ที่เกี่ยวข้องที่ผ่านบริการ เพื่อวัตถุประสงค์ส่วนตัวและไม่ใช่เชิงพาณิชย์เท่านั้น

สิทธิทั้งหมดที่ไม่ได้รับอนุญาตในที่นี้ ถือเป็นกรรมสิทธิ์ของ EVOLT และผู้ให้อนุญาตแก่ EVOLT

4.2 ข้อจำกัด

ผู้ใช้งานตกลงที่จะไม่ดำเนินการดังต่อไปนี้:

  1. ลบข้อความเกี่ยวกับลิขสิทธิ์ เครื่องหมายการค้า หรือสิทธิในทรัพย์สินทางปัญญาใด ๆ ออกจากส่วนใดของบริการ;
  2. ผลิตซ้ำ แก้ไข ลอกเลียนแบบ ดัดแปลง แจกจ่าย อนุญาตให้ใช้สิทธิ ให้เช่า ขาย โอน แสดงต่อสาธารณะ แสดง เผยแพร่ ส่งผ่าน แพร่ภาพ ใช้ประโยชน์จากบริการหรือคอนเทนต์ใด ๆ เพื่อวัตถุประสงค์ในทางสาธารณะหรือในทางธุรกิจเชิงพาณิชย์ รวมถึงในรูปแบบหรือวิธีการใด ๆ ที่มีลักษณะคล้ายคลึงกัน เว้นแต่จะได้รับอนุญาตโดยชัดแจ้งจาก EVOLT;
  3. ถอดรหัส ทำวิศวกรรมย้อนกลับ หรือแยกส่วนของบริการ ยกเว้นตามที่กฎหมายอนุญาต;
  4. เชื่อมโยง สะท้อน หรือสร้างกรอบสำหรับส่วนใดของบริการ;
  5. ใช้สคริปต์ โปรแกรมอัตโนมัติ หรือวิธีการอื่นใดเพื่อดึงข้อมูล จัดทำดัชนี หรือรวบรวมข้อมูลจากบริการ หรือแทรกแซงการทำงานหรือประสิทธิภาพของบริการ;
  6. พยายามเข้าถึงหรือแทรกแซงส่วนใด ๆ ของบริการ ระบบที่เกี่ยวข้อง หรือเครือข่ายโดยไม่ได้รับอนุญาต

4.3 การใช้แบรนด์ของ EVOLT

ผู้ใช้งานรับทราบว่าส่วนหนึ่งของบริการอาจให้บริการภายใต้แบรนด์ EVOLT หรือแบรนด์ที่เกี่ยวข้อง

4.4 สิทธิในทรัพย์สิน

สิทธิ ชื่อ และผลประโยชน์ในและต่อบริการ รวมถึงสิทธิในทรัพย์สินทางปัญญาทั้งหมด (รวมถึงแต่ไม่จำกัดเพียง โลโก้ เครื่องหมายการค้า โปรแกรม หรือ ซอฟต์แวร์ใด ๆ) ยังคงเป็นกรรมสิทธิ์เฉพาะของ EVOLT หรือผู้ให้อนุญาตแก่ EVOLT ข้อกำหนดนี้ไม่ได้ให้สิทธิใด ๆ แก่ผู้ใช้งานใน:

  1. บริการ ยกเว้นสิทธิการใช้งานที่จำกัดตามที่ระบุไว้ในที่นี้; หรือ
  2. การใช้หรืออ้างอิงชื่อ เครื่องหมายการค้า ชื่อผลิตภัณฑ์และบริการ เครื่องหมายบริการ หรือสิ่งบ่งชี้อื่นใดของ EVOLT เว้นแต่จะได้รับอนุญาตเป็นลายลักษณ์อักษรล่วงหน้า

4.5 การจองสถานีชาร์จ

ผู้ใช้งานสามารถค้นหาและจองสถานีชาร์จผ่านแอปพลิเคชัน ซึ่งขึ้นอยู่กับความพร้อมของสถานีและข้อจำกัดด้านเวลา การจองแต่ละครั้งอาจกำหนดเวลาที่ผู้ใช้งานต้องเริ่มต้นการชาร์จ หากผู้ใช้งานไม่เริ่มชาร์จภายในเวลาที่กำหนด การจองอาจถูกยกเลิกโดยอัตโนมัติ EVOLT ขอสงวนสิทธิ์ในการเรียกเก็บค่าธรรมเนียมหากผู้ใช้งานไม่ยกเลิกการจองภายในเวลาที่กำหนด หรือไม่ปฏิบัติตามนโยบายการยกเลิกที่ระบุไว้ผ่านแอปพลิเคชันหรือช่องทางอื่น ๆ

4.6 เงื่อนไขเฉพาะของฟีเจอร์

แต่ละฟีเจอร์หลักภายในแอปพลิเคชันอยู่ภายใต้เงื่อนไขการใช้งานเฉพาะ ซึ่งกำหนดรูปแบบการให้บริการ ข้อมูลที่แอปพลิเคชันอาจเก็บรวบรวม และเงื่อนไขทางกฎหมายหรือการดำเนินงานที่เกี่ยวข้อง ดังนี้:

4.6.1 ค้นหาสถานีชาร์จ

  1. ผู้ใช้งานสามารถค้นหาและดูตำแหน่งของสถานีชาร์จรถยนต์ไฟฟ้าผ่านแอปพลิเคชัน
  2. แอปพลิเคชันอาจเข้าถึงข้อมูลตำแหน่งของผู้ใช้งานเพื่อแสดงสถานีใกล้เคียง โดยต้องได้รับความยินยอมจากผู้ใช้งานก่อน
  3. ข้อมูลสถานีชาร์จอาจมีการเปลี่ยนแปลงตามเวลาจริง EVOLT ไม่รับประกันความถูกต้องหรือความพร้อมใช้งานของสถานีทุกแห่ง

4.6.2 ใบเสร็จรับเงินและใบกำกับภาษีเต็มรูปแบบ

  1. ภายหลังการทำรายการ ผู้ใช้งานสามารถดาวน์โหลดใบเสร็จผ่านแอปพลิเคชัน
  2. ผู้ใช้งานที่ต้องการใบกำกับภาษีเต็มรูปแบบต้องระบุข้อมูลเพิ่มเติม เช่น ชื่อบริษัท ที่อยู่ และหมายเลขประจำตัวผู้เสียภาษี
  3. ใบเสร็จและใบกำกับภาษีออกตามหลักเกณฑ์ภาษีของประเทศไทย และผู้ใช้งานต้องรับผิดชอบในการให้ข้อมูลที่ถูกต้อง EVOLT ไม่รับผิดชอบต่อข้อผิดพลาดจากข้อมูลที่ผู้ใช้งานให้ไม่ถูกต้อง

4.6.3 การแจ้งเตือน

  1. แอปพลิเคชันสามารถส่งการแจ้งเตือนเกี่ยวกับธุรกรรม สถานะการชาร์จ หรือข้อเสนอพิเศษไปยังอุปกรณ์ของผู้ใช้งาน
  2. ผู้ใช้งานสามารถจัดการการตั้งค่าการแจ้งเตือนได้ภายในแอปพลิเคชัน
  3. การแจ้งเตือนอาจถูกส่งผ่านระบบของบุคคลภายนอก ซึ่ง EVOLT ไม่สามารถรับประกันความถูกต้องหรือความตรงต่อเวลาในการจัดส่งได้

4.6.4 กระเป๋าเงิน (Wallet)

  1. ผู้ใช้งานสามารถเติมเงินเข้าสู่กระเป๋าเงินภายในแอปพลิเคชันเพื่อใช้ชำระค่าบริการ
  2. จำนวนเงินที่เติมไม่สามารถแลกคืนเป็นเงินสด ถอนออก หรือโอนไปยังบัญชีอื่นได้
  3. แอปพลิเคชันอาจแสดงประวัติการทำธุรกรรมของกระเป๋าเงินเพื่อให้ผู้ใช้งานสามารถตรวจสอบการใช้งานย้อนหลัง
  4. (ง) EVOLT ขอสงวนสิทธิในการปรับเปลี่ยนเงื่อนไขของกระเป๋าเงิน รวมถึงระยะเวลาหมดอายุของยอดเงิน หรือข้อจำกัดด้านยอดเงิน โดยไม่ต้องแจ้งให้ทราบล่วงหน้า

ฟีเจอร์ต่าง ๆ ในแอปพลิเคชันอาจมีการปรับปรุง แก้ไข หรือเปลี่ยนแปลงเป็นระยะ และ EVOLT ขอสงวนสิทธิในการเปลี่ยนแปลงฟังก์ชัน เงื่อนไข หรือข้อกำหนดต่าง ๆ ของฟีเจอร์ดังกล่าวโดยไม่ต้องแจ้งให้ทราบล่วงหน้า

4.7 การจัดการข้อมูลส่วนบุคคล

แอปพลิเคชันจะเก็บ ใช้ และประมวลผลข้อมูลที่เกี่ยวข้องกับการค้นหาสถานีชาร์จและสถานีที่ถูกบันทึกเป็นรายการโปรดของผู้ใช้งานเพื่อปรับปรุงประสิทธิภาพการให้บริการ โดยสอดคล้องกับหลักการคุ้มครองข้อมูลส่วนบุคคล ดังนี้:

4.7.1 การเก็บข้อมูล

  1. แอปพลิเคชันอาจเก็บข้อมูลเกี่ยวกับการค้นหาสถานีชาร์จและสถานีที่ผู้ใช้งานบันทึกไว้เป็นรายการโปรด
  2. แอปพลิเคชันอาจเข้าถึงข้อมูลตำแหน่งของผู้ใช้งานเพื่อแสดงสถานีใกล้เคียง โดยต้องได้รับความยินยอมจากผู้ใช้งานก่อน

4.7.2 การใช้ข้อมูล

  1. เพื่อแสดงผลการค้นหาที่เกี่ยวข้อง และแนะนำสถานีที่ใช้งานบ่อย
  2. เพื่อวิเคราะห์และปรับปรุงประสิทธิภาพของแอปพลิเคชัน

4.7.3 การเปิดเผยข้อมูล

  1. EVOLT จะไม่เปิดเผยข้อมูลส่วนบุคคลของผู้ใช้งานแก่บุคคลภายนอกโดยไม่ได้รับความยินยอม
  2. ข้อมูลที่ไม่สามารถระบุตัวตนได้อาจถูกเปิดเผยแก่พันธมิตรทางธุรกิจของ EVOLT เพื่อวัตถุประสงค์ในการพัฒนาบริการ

4.7.4 ความปลอดภัยของข้อมูล

  1. ข้อมูลทั้งหมดจะได้รับการจัดเก็บและปกป้องตามมาตรฐานความปลอดภัยในระดับสูง
  2. ผู้ใช้งานสามารถจัดการหรือร้องขอให้ลบข้อมูลของตนเองได้ผ่านการตั้งค่าในแอปพลิเคชัน

5. การใช้บริการโดยผู้ใช้งาน

5.1 การลงทะเบียนบัญชีผู้ใช้งาน

เพื่อให้สามารถเข้าถึงและใช้ฟีเจอร์ทั้งหมดของบริการได้ ผู้ใช้งานจะต้องดำเนินการลงทะเบียนและดูแลรักษาบัญชีส่วนบุคคล ผู้ใช้งานต้องมีอายุไม่ต่ำกว่า 18 ปี หรือบรรลุนิติภาวะตามที่กฎหมายไทยกำหนด หากผู้ใช้งานยังไม่บรรลุนิติภาวะตามกฎหมายดังกล่าว ผู้ใช้งานจะต้องได้รับความยินยอมจากบิดา มารดา หรือผู้แทนโดยชอบธรรมในการลงทะเบียนบัญชี

ในขั้นตอนการลงทะเบียน ผู้ใช้งานจะต้องให้ข้อมูลที่ถูกต้องเป็นปัจจุบัน และครบถ้วน ซึ่งรวมถึงแต่ไม่จำกัดเพียง ชื่อ ที่อยู่ หมายเลขโทรศัพท์ อีเมล อายุ และวิธีการชำระเงินที่ถูกต้อง (เช่น บัตรเครดิต หรือวิธีการชำระเงินอื่นที่ EVOLT รองรับ) ผู้ใช้งานมีหน้าที่รับผิดชอบในการปรับปรุงข้อมูลให้ถูกต้อง ครบถ้วน และเป็นปัจจุบันอยู่เสมอ การไม่ปฏิบัติตามเงื่อนไขนี้อาจส่งผลให้ผู้ใช้งานไม่สามารถเข้าถึงหรือใช้บริการ และ EVOLT มีสิทธิพิจารณาเพื่อระงับหรือยกเลิกการใช้บัญชีของผู้ใช้งานโดยไม่จำเป็นต้องแจ้งให้ทราบล่วงหน้า

ผู้ใช้งานจะต้องรับผิดชอบต่อกิจกรรมทั้งหมดที่ดำเนินการภายใต้บัญชีของตนเอง และจะต้องรักษาความปลอดภัยและความลับของชื่อผู้ใช้งานและรหัสผ่านไว้ ผู้ใช้งานไม่ได้รับอนุญาตให้สร้างบัญชีมากกว่าหนึ่งบัญชี เว้นแต่จะได้รับความยินยอมเป็นลายลักษณ์อักษรจาก EVOLT

5.2 การสื่อสาร

เมื่อดำเนินการสร้างบัญชี ผู้ใช้งานตกลงที่จะรับการสื่อสารที่เกี่ยวข้องกับบริการ ซึ่งรวมถึงแต่ไม่จำกัดเพียง ข้อความทางโทรศัพท์ (SMS) และ อีเมล จาก EVOLT ซึ่งเป็นส่วนหนึ่งของการดำเนินการตามปกติที่เกี่ยวข้องกับการเข้าถึงและการใช้บริการ

5.3 การเข้าถึงเครือข่ายและอุปกรณ์

ผู้ใช้งานมีหน้าที่รับผิดชอบในการจัดหาและรักษาการเข้าถึงเครือข่ายข้อมูลที่จำเป็นสำหรับการใช้บริการ ทั้งนี้ ค่าบริการข้อมูลหรือข้อความอาจถูกเรียกเก็บโดยผู้ให้บริการเครือข่ายโทรศัพท์มือถือหรือเครือข่ายอินเตอร์เนตของผู้ใช้งาน ซึ่ง EVOLT ไม่มีส่วนเกี่ยวข้องหรือรับผิดชอบต่อค่าใช้จ่ายดังกล่าว

ผู้ใช้งานมีหน้าที่จัดหาและบำรุงรักษาอุปกรณ์หรือฮาร์ดแวร์ที่เหมาะสมสำหรับการเข้าถึงและการใช้แอปพลิเคชัน รวมถึงการอัปเดตที่อาจจำเป็น ทั้งนี้ EVOLT ไม่รับรองหรือรับประกันว่าบริการจะสามารถใช้งานได้บนอุปกรณ์หรือฮาร์ดแวร์เฉพาะใดๆ และบริการอาจเผชิญปัญหาการทำงานผิดพลาด ความล่าช้า หรือปัญหาอื่นที่เกิดจากการเชื่อมต่ออินเทอร์เน็ตหรือระบบสื่อสารอิเล็กทรอนิกส์ ซึ่งอยู่นอกเหนือการควบคุมของ EVOLT

6. การชำระเงิน

6.1 การรับทราบค่าใช้จ่าย

ผู้ใช้งานรับทราบและตกลงว่าการใช้บริการอาจก่อให้เกิดค่าใช้จ่ายสำหรับบริการที่จัดทำโดยผู้ให้บริการ เมื่อการให้บริการเสร็จสมบูรณ์ EVOLT จะทำหน้าที่เป็นตัวแทนเรียกเก็บเงินที่จำกัดในนามของผู้ให้บริการ เพื่ออำนวยความสะดวกในการชำระค่าใช้จ่ายดังกล่าว การชำระเงินผ่าน EVOLT จะถือว่าเทียบเท่ากับการชำระเงินโดยตรงต่อผู้ให้บริการ

ค่าใช้จ่ายจะรวมถึงภาษีที่กฎหมายกำหนด และผู้ใช้งานต้องชำระเงินเต็มจำนวนทันทีเมื่อสิ้นสุดการให้บริการ; เว้นแต่จะระบุไว้เป็นอย่างอื่น การชำระเงินทั้งหมดถือเป็นที่สิ้นสุดและไม่สามารถขอคืนเงินได้ โดยทั่วไปจะไม่มีการคืนเงินในกรณีที่เกิดข้อผิดพลาดจากผู้ใช้งาน รวมถึงแต่ไม่จำกัดเพียง การเลือกบริการที่ไม่ถูกต้อง หรือการใช้งานบริการที่ไม่เหมาะสม EVOLT จะดำเนินการชำระเงินผ่านวิธีการชำระเงินที่ผู้ใช้งานระบุไว้ในบัญชี และหลังจากการชำระเงินเสร็จสิ้น EVOLT จะออกใบเสร็จรับเงินให้ผู้ใช้งานผ่านทางอีเมล

EVOLT ขอสงวนสิทธิ์ตามดุลยพินิจแต่เพียงผู้เดียวในการกำหนด แก้ไข หรือปรับค่าใช้จ่ายสำหรับบริการ ผลิตภัณฑ์ หรือส่วนใด ๆ ของบริการที่มีให้ผ่านแอปพลิเคชัน การเปลี่ยนแปลงดังกล่าวจะมีผลทันทีเมื่อมีการโพสต์หรือแจ้งให้ทราบ เว้นแต่จะระบุไว้เป็นอย่างอื่น

6.2 วิธีการชำระเงิน

การชำระเงินสำหรับการชาร์จสามารถดำเนินการผ่าน กระเป๋าเงินในแอปพลิเคชัน หรือ บัตรเครดิตหรือบัตรเดบิต หรือ ช่องทางการชำระเงินออนไลน์อื่น ๆ ที่แอปพลิเคชันรองรับ

6.3 อัตราค่าชาร์จ

อัตราค่าชาร์จอาจแตกต่างกันไปตามปัจจัยต่าง ๆ เช่น ประเภทการชาร์จ (AC/DC) ตำแหน่งที่ตั้งของสถานีชาร์จ และระยะเวลาการชาร์จ

6.4 การเติมเงินในกระเป๋าเงินในแอปพลิเคชัน

ผู้ใช้งานสามารถเติมเงินในกระเป๋าเงินในแอปพลิเคชันได้อย่างปลอดภัยผ่าน Web View ภายในแอปพลิเคชัน วิธีการเติมเงินที่รองรับ ได้แก่ QR Code ไทย และบัตรเครดิต

6.5 การจัดการกระเป๋าเงินในแอปพลิเคชัน

ผู้ใช้งานมีหน้าที่รับผิดชอบแต่เพียงผู้เดียวในการจัดการยอดเงินในกระเป๋าเงินออนไลน์ของตน และรักษาความปลอดภัยของข้อมูลบัตรเครดิตที่จัดเก็บไว้ในแอปพลิเคชัน ผู้ใช้งานสามารถเข้าถึงรายงานสรุปการใช้งานรายเดือนย้อนหลังสอง ปีได้ผ่านแอปพลิเคชันเพื่อการอ้างอิงและตรวจสอบข้อมูล

6.6 เครดิตสะสม

6.6.1 ขอบเขตของเครดิตสะสม

  1. เครดิตที่ได้ทำการเติมแล้ว ไม่สามารถแลกคืนเป็นเงินสด ถอนออก หรือโอนให้กับบัญชีของผู้ใช้งานรายอื่นได้ไม่ว่ากรณีใด ๆ
  2. เครดิตจะผูกกับบัญชีผู้ใช้งานแต่เพียงรายเดียว และสามารถใช้ได้เฉพาะกับบัญชีนั้นเท่านั้น

6.6.2 การเติมเครดิต

  1. ผู้ใช้งานสามารถเติมเครดิตผ่านช่องทางการชำระเงินที่แอปพลิเคชันรองรับ ซึ่งอาจรวมถึงแต่ไม่จำกัดเพียง บัตรเครดิต/เดบิต การโอนเงินผ่านธนาคาร หรือช่องทางการชำระเงินอิเล็กทรอนิกส์อื่น ๆ ที่EVOLTกำหนด
  2. เมื่อการเติมเครดิตสำเร็จ จะไม่สามารถขอคืนเงินได้ และเครดิตที่เติมจะไม่สามารถแปลงเป็นเงินสดหรือโอนย้ายไปยังบัญชีอื่นได้

6.6.3 การใช้เครดิต

  1. เครดิตสามารถใช้ได้เฉพาะภายในแอปพลิเคชันสำหรับการซื้อสินค้า บริการ หรือแพ็กเกจต่าง ๆ ที่EVOLTกำหนดไว้
  2. เครดิตที่ได้ถูกใช้งานแล้ว ไม่สามารถขอคืนได้ ยกเว้นในกรณีที่เกิดข้อผิดพลาดจากระบบของแอปพลิเคชัน
  3. ผู้ใช้งานต้องไม่ดำเนินการ หรือพยายามดำเนินการโอนเครดิตไปยังบัญชีอื่น หากตรวจพบการกระทำดังกล่าว EVOLTขอสงวนสิทธิในการระงับการใช้งานบัญชีผู้ใช้งานชั่วคราวหรือถาวรตามความเหมาะสม

6.6.4 เงื่อนไขการหมดอายุของเครดิต

  1. เครดิตอาจมีระยะเวลาการใช้งานตามที่EVOLTกำหนด หากมิได้ใช้ภายในระยะเวลาดังกล่าว เครดิตนั้นจะหมดอายุและไม่สามารถขอคืนได้
  2. EVOLTขอสงวนสิทธิในการเปลี่ยนแปลงระยะเวลาหมดอายุของเครดิตได้ทุกเมื่อ โดยไม่จำเป็นต้องแจ้งให้ทราบล่วงหน้า

6.6.5 ข้อสงวนสิทธิ์และความรับผิด

  1. EVOLTขอสงวนสิทธิในการยกเลิก แก้ไข ระงับ หรือยุติบัญชี8งาน หากพบว่ามีการใช้เครดิตโดยมิชอบ หรือฝ่าฝืนข้อกำหนดและเงื่อนไขของแอปพลิเคชัน
  2. EVOLTจะไม่รับผิดชอบต่อความเสียหาย การสูญเสีย หรือค่าใช้จ่ายใด ๆ ที่เกิดจากการใช้เครดิตโดยไม่เหมาะสม หรือความพยายามในการโอนเครดิตไปยังบัญชีอื่นโดยไม่ได้รับอนุญาต

7. ข้อจำกัดความรับผิด

7.1 ภายใต้ขอบเขตสูงสุดที่กฎหมายที่ใช้บังคับอนุญาต EVOLT จะไม่ต้องรับผิดในความเสียหายใด ๆ ทั้งสิ้น เว้นแต่ในกรณีที่กฎหมายบัญญัติไว้อย่างชัดแจ้งให้ต้องรับผิด ความเสียหายดังกล่าวรวมถึงแต่ไม่จำกัดเพียง ความเสียหายทางอ้อม ความเสียหายโดยบังเอิญ ความเสียหายที่เป็นผลสืบเนื่อง ความเสียหายเชิงลงโทษ หรือความเสียหายเชิงแบบอย่าง เช่น การสูญเสียผลกำไร การสูญเสียหรือความเสียหายของข้อมูล หรือความเสียหายต่อทรัพย์สิน หรือการสูญเสียทรัพย์สิน ซึ่งเกิดขึ้นจากหรือเกี่ยวข้องกับการใช้ หรือการไม่สามารถใช้บริการได้ ไม่ว่าจะมีสาเหตุมาจากความประมาทเลินเล่อ เหตุสุดวิสัย หรือกรณีอื่นใดที่อยู่นอกเหนือการควบคุมโดยชอบของ EVOLT

อย่างไรก็ดี ข้อจำกัดความรับผิดข้างต้นจะไม่มีผลบังคับใช้ในกรณีดังต่อไปนี้:

  1. ความเสียหายจากการเสียชีวิตหรือการบาดเจ็บทางร่างกายที่เกิดจากความประมาทเลินเล่อของ EVOLT ซึ่งสามารถพิสูจน์ได้;
  2. ความเสียหายที่เกิดจากการกระทำโดยเจตนา หรือความประมาทเลินเล่ออย่างร้ายแรงของ EVOLT; หรือ
  3. ความรับผิดที่ไม่อาจจำกัดหรือยกเว้นได้ตามกฎหมายที่ใช้บังคับ

7.2 ผู้ใช้งานตกลงให้การชดใช้ค่าเสียหาย และให้ความคุ้มครองแก่ EVOLT รวมถึงกรรมการ ผู้บริหาร พนักงาน ตัวแทน และผู้แทนของบริษัท จากความเสียหาย ความสูญเสีย ภาระผูกพัน ค่าใช้จ่าย หรือค่าธรรมเนียมใด ๆ (รวมถึงแต่ไม่จำกัดเพียง ค่าทนายความที่สมเหตุสมผล) ที่เกิดขึ้นจากหรือเกี่ยวข้องกับ:

  1. การใช้บริการ หรือการใช้บริการใด ๆ ผ่านบัญชีของผู้ใช้งาน;
  2. การละเมิดข้อกำหนดและเงื่อนไขฉบับนี้โดยผู้ใช้งาน; หรือ
  3. การใช้งานโดยไม่ได้รับอนุญาต หรือการใช้งานโดยมิชอบของผู้ใช้งานต่อเนื้อหา ทรัพย์สินทางปัญญา หรือทรัพย์สินอื่นใดของ EVOLT

EVOLT ขอสงวนสิทธิแต่เพียงผู้เดียว ในการแก้ไข ระงับ หรือยกเลิกการให้บริการใด ๆ ไม่ว่าในส่วนทั้งหมดหรือบางส่วน รวมถึงแต่ไม่จำกัดเพียง บริการจอง บริการเริ่มต้นการใช้งาน การปรับเปลี่ยนบริการ หรือฟีเจอร์การดำเนินการชำระเงิน ได้ทุกเมื่อ โดยไม่จำเป็นต้องแจ้งให้ทราบล่วงหน้า และโดยไม่มีข้อผูกพันใด ๆ ต่อความรับผิดที่อาจเกิดขึ้นจากการดำเนินการดังกล่าว

8. กฎหมายและการระงับข้อพิพาท

การใช้บริการและการตีความข้อกำหนดเหล่านี้จะอยู่ภายใต้และตีความตามกฎหมายของราชอาณาจักรไทย โดยไม่คำนึงถึงหลักการขัดกันของกฎหมาย

ในกรณีที่มีข้อพิพาท ข้อโต้แย้ง หรือข้อเรียกร้องใด ๆ ที่เกิดขึ้นจากหรือเกี่ยวข้องกับข้อกำหนดฉบับนี้หรือการใช้บริการ คู่สัญญาจะพยายามแก้ไขข้อพิพาทด้วยความสุจริตโดยการเจรจาต่อรองกัน หากคู่สัญญาไม่สามารถตกลงกันได้ภายในสามสิบ (30) วันนับจากวันที่เกิดข้อพิพาท

จะต้องได้รับการระงับโดยกระบวนการอนุญาโตตุลาการตามกฎของสถาบันอนุญาโตตุลาการ กระทรวงยุติธรรมของประเทศไทย ซึ่งมีผลบังคับใช้ในขณะยื่นข้อพิพาท การอนุญาโตตุลาการจะดำเนินการในกรุงเทพมหานคร ประเทศไทย และคำตัดสินของอนุญาโตตุลาการถือเป็นที่สุดและมีผลผูกพันต่อทั้งสองฝ่าย

คู่สัญญาตกลงที่จะรับผิดชอบค่าใช้จ่ายในการอนุญาโตตุลาการและค่าใช้จ่ายที่เกี่ยวข้องอย่างเท่าเทียมกัน เว้นแต่จะมีคำตัดสินอื่นโดยอนุญาโตตุลาการ ในกรณีที่มีการแต่งตั้งอนุญาโตตุลาการ ค่าธรรมเนียมและค่าใช้จ่ายของอนุญาโตตุลาการจะถูกกำหนดโดยอนุญาโตตุลาการตามข้อบังคับที่เกี่ยวข้อง

นโยบายความเป็นส่วนตัว

นโยบายความเป็นส่วนตัวฉบับนี้อธิบายวิธีการที่ EVOLT เก็บรวบรวม ใช้ และเปิดเผยข้อมูลส่วนบุคคลจากผู้ที่เข้าถึงหรือใช้บริการของเราการเลือกใช้บริการของเราถือว่าผู้ใช้งานยอมรับการเก็บรวบรวมและการใช้งานข้อมูลตามที่ระบุในนโยบายความเป็นส่วนตัวฉบับนี้และตามที่กฎหมายที่เกี่ยวข้องอนุญาต

1. การคุ้มครองข้อมูลส่วนบุคคล

1.1 การเก็บรวบรวมข้อมูลส่วนบุคคล

EVOLT ดำเนินการเก็บรวบรวม ประมวลผล และจัดเก็บข้อมูลส่วนบุคคลโดยเป็นไปตามพระราชบัญญัติคุ้มครองข้อมูลส่วนบุคคล พ.ศ. 2562 (“PDPA”) และกฎหมายคุ้มครองข้อมูลส่วนบุคคลที่เกี่ยวข้อง ข้อมูลส่วนบุคคลที่อาจถูกเก็บรวบรวม ได้แก่:

  1. ข้อมูลประจำตัวและข้อมูลติดต่อ – ชื่อ-นามสกุล วันเดือนปีเกิด สัญชาติ ข้อมูลจากเอกสารระบุตัวตนที่ออกโดยหน่วยงานภาครัฐ (เช่น หนังสือเดินทาง บัตรประชาชน หรือใบขับขี่) อีเมล หมายเลขโทรศัพท์ และที่อยู่ที่ใช้ในการติดต่อหรือออกใบแจ้งหนี้
  2. ข้อมูลยานพาหนะ – หมายเลขทะเบียนรถ รุ่น ปีที่ผลิต หมายเลขตัวถังรถยนต์ (VIN) และข้อมูลอื่นที่เกี่ยวข้อง
  3. ข้อมูลการชำระเงินและธุรกรรมทางการเงิน – ข้อมูลบัตรเครดิต/เดบิต ข้อมูลบัญชีธนาคาร รายละเอียดการเรียกเก็บเงิน ประวัติการทำธุรกรรม และการตั้งค่าการชำระเงิน
  4. ข้อมูลบัญชีและการใช้งานบริการ – ชื่อผู้ใช้งาน รหัสผ่าน การตั้งค่าบริการ บันทึกธุรกรรม การติดต่อกับฝ่ายสนับสนุนลูกค้า และประวัติการสื่อสารกับบริษัท
  5. ข้อมูลทางเทคนิคและอุปกรณ์ – ที่อยู่ IP ประเภทเบราว์เซอร์ ระบบปฏิบัติการ ข้อมูลตำแหน่งที่ตั้ง หมายเลขอุปกรณ์ คุกกี้ และข้อมูลวิเคราะห์การใช้งานที่รวบรวมผ่านแพลตฟอร์มดิจิทัลของ EVOLT
  6. ข้อมูลส่วนบุคคลอื่น ๆ – ข้อมูลเพิ่มเติมที่ผู้ใช้งานให้แก่บริษัทผ่านแบบฟอร์ม การสำรวจ หรือการสื่อสารโดยตรงกับ EVOLT

1.2 วัตถุประสงค์ของการประมวลผลข้อมูล

  1. การให้บริการและการจัดการบัญชี – การดำเนินธุรกรรม การตรวจสอบและจัดการบัญชีของผู้ใช้งาน และการให้บริการลูกค้า
  2. การพัฒนาธุรกิจและการดำเนินงาน – การวิเคราะห์พฤติกรรมผู้ใช้งาน การปรับปรุงบริการ และการพัฒนาผลิตภัณฑ์ใหม่
  3. การปฏิบัติตามกฎหมายและข้อกำหนดทางกฎหมาย – การดำเนินการให้เป็นไปตามข้อกำหนดทางกฎหมาย กฎระเบียบ และสัญญา
  4. การรักษาความปลอดภัยและการป้องกันการฉ้อโกง – การป้องกันกิจกรรมฉ้อโกง ภัยคุกคามทางไซเบอร์ และการเข้าถึงที่ไม่ได้รับอนุญาต
  5. การตลาดและการสื่อสาร – การส่งข้อมูลอัปเดตเกี่ยวกับบริการ โปรโมชั่น จดหมายข่าว และข้อเสนอพิเศษ โดยจะดำเนินการภายใต้ข้อกำหนดการให้ความยินยอมของผู้ใช้งาน ตามที่กฎหมายกำหนด
  6. การปฏิบัติตามข้อบังคับทางกฎหมายและกฎระเบียบ – การตอบสนองต่อคำขอจากหน่วยงานภาครัฐ ศาล หรือหน่วยงานกำกับดูแล การบังคับใช้สิทธิ์ตามสัญญา และการคุ้มครองผลประโยชน์ทางกฎหมายของ EVOLT

1.3 การแบ่งปันและเปิดเผยข้อมูลส่วนบุคคล

  1. บริษัทในเครือและพันธมิตรทางธุรกิจ – เพื่อให้บริการ ปรับปรุง และพัฒนาบริการของ EVOLT
  2. ผู้ให้บริการ – เช่น ผู้ให้บริการชำระเงิน ผู้ให้บริการเทคโนโลยีสารสนเทศ ผู้ให้บริการจัดเก็บข้อมูลบนคลาวด์ และผู้ให้บริการวิเคราะห์ข้อมูล โดยอยู่ภายใต้เงื่อนไขการรักษาความลับ
  3. หน่วยงานทางกฎหมายและหน่วยงานกำกับดูแล – ในกรณีที่มีข้อกำหนดทางกฎหมาย คำสั่งศาล หรือข้อกำหนดจากหน่วยงานกำกับดูแลที่เกี่ยวข้อง
  4. ธุรกรรมทางธุรกิจ – ในกรณีที่มีการควบรวมกิจการ การปรับโครงสร้างองค์กร หรือการโอนสินทรัพย์ โดยต้องดำเนินการภายใต้มาตรการคุ้มครองข้อมูลที่เหมาะสม
  5. การป้องกันการฉ้อโกงและการบังคับใช้กฎหมาย – เมื่อจำเป็นต้องดำเนินการเพื่อป้องกันการฉ้อโกง รักษาสิทธิทางกฎหมายของ EVOLT หรือรักษาความปลอดภัยและความเป็นระเบียบเรียบร้อย

1.4 มาตรการรักษาความปลอดภัยและการเก็บรักษาข้อมูล

EVOLT ใช้มาตรการรักษาความปลอดภัยทั้งทางเทคนิค การบริหารจัดการ และมาตรการทางองค์กรเพื่อปกป้องข้อมูลส่วนบุคคลจากการเข้าถึงโดยไม่ได้รับอนุญาต การเปลี่ยนแปลง การเปิดเผย หรือการทำลายข้อมูลโดยมิชอบ ทั้งนี้ ข้อมูลส่วนบุคคลจะถูกเก็บรักษาเพียงเท่าที่จำเป็นเพื่อให้บรรลุวัตถุประสงค์ที่ระบุไว้ เว้นแต่กฎหมายกำหนดให้เก็บรักษาไว้เป็นระยะเวลานานกว่า เมื่อครบกำหนด ข้อมูลดังกล่าวจะถูกลบหรือทำให้เป็นข้อมูลนิรนามอย่างปลอดภัย

1.5 สิทธิของผู้ใช้งาน

  1. สิทธิในการเข้าถึง – ขอเข้าถึงและขอรับสำเนาข้อมูลส่วนบุคคลของตน
  2. สิทธิในการแก้ไขข้อมูล – ขอแก้ไขข้อมูลที่ไม่ถูกต้องหรือไม่สมบูรณ์
  3. สิทธิในการลบข้อมูล – ขอให้ลบหรือทำให้ข้อมูลเป็นนิรนาม เว้นแต่มีข้อยกเว้นตามกฎหมาย
  4. สิทธิในการจำกัดการประมวลผล – ขอให้จำกัดการประมวลผลข้อมูลภายใต้เงื่อนไขที่กำหนด
  5. สิทธิในการเพิกถอนความยินยอม – เพิกถอนความยินยอมในการใช้ข้อมูลได้ทุกเมื่อ โดยไม่มีผลกระทบต่อการประมวลผลที่ได้ดำเนินการก่อนหน้านั้น
  6. สิทธิในการร้องเรียน – ยื่นคำร้องต่อหน่วยงานกำกับดูแลหากเห็นว่า EVOLT ละเมิดสิทธิความเป็นส่วนตัว

2. ข้อมูลส่วนบุคคลที่อ่อนไหว

2.1 การไม่เก็บรวบรวมและประมวลผลข้อมูลที่อ่อนไหว

EVOLT ไม่มีนโยบายเก็บรวบรวม ใช้ เปิดเผย หรือประมวลผลข้อมูลส่วนบุคคลที่อ่อนไหว เว้นแต่มีข้อกำหนดทางกฎหมาย หรือมีความจำเป็นสำหรับการให้บริการ และได้รับความยินยอมโดยชัดแจ้งจากผู้ใช้งาน ข้อมูลส่วนบุคคลที่อ่อนไหว (“Sensitive Personal Data”) ได้แก่ ข้อมูลเกี่ยวกับเชื้อชาติหรือชาติพันธุ์ ความคิดเห็นทางการเมือง ความเชื่อทางศาสนา หรือปรัชญา ข้อมูลพันธุกรรม ข้อมูลชีวมิติ ข้อมูลสุขภาพ และรสนิยมทางเพศ

2.2 การเปิดเผยข้อมูลโดยไม่เจตนา

หากผู้ใช้งานให้ข้อมูลส่วนบุคคลที่อ่อนไหวแก่ EVOLT โดยไม่ได้รับการร้องขอ EVOLT ขอสงวนสิทธิ์ในการลบ ทำให้เป็นข้อมูลนิรนาม หรือกำจัดข้อมูลดังกล่าวออกจากฐานข้อมูลโดยไม่ต้องแจ้งให้ทราบล่วงหน้า ทั้งนี้ จะดำเนินการภายในขอบเขตที่กฎหมายอนุญาต

2.3 เงื่อนไขในการประมวลผลข้อมูลส่วนบุคคลที่อ่อนไหว

  1. มีความจำเป็นเพื่อให้บริการ และได้รับความยินยอมโดยชัดแจ้งจากผู้ใช้งาน;
  2. มีข้อกำหนดทางกฎหมาย ข้อบังคับ หรือเป็นไปตามคำสั่งศาลที่มีผลบังคับทางกฎหมาย;
  3. จำเป็นสำหรับการดำเนินคดี หรือการใช้สิทธิ์ทางกฎหมายของบริษัทหรือบุคคลอื่น; หรือ
  4. จำเป็นเพื่อประโยชน์สาธารณะที่สำคัญ โดยอยู่ภายใต้มาตรการป้องกันที่เหมาะสม

2.4 มาตรการรักษาความปลอดภัยและการรักษาความลับ

หาก EVOLT มีความจำเป็นต้องประมวลผลข้อมูลส่วนบุคคลที่อ่อนไหว บริษัทจะใช้มาตรการรักษาความปลอดภัยที่เข้มงวด และปฏิบัติตามกฎหมายคุ้มครองข้อมูลส่วนบุคคลที่เกี่ยวข้อง เพื่อให้มั่นใจว่ามีการคุ้มครองข้อมูลในระดับสูงสุด

3. ขอบเขตและการใช้งานข้อมูลส่วนบุคคล

3.1 วัตถุประสงค์ของการเก็บรวบรวมและใช้ข้อมูล

  1. การให้บริการ – การจัดการบัญชี การดำเนินธุรกรรม และการให้บริการลูกค้า
  2. การวิเคราะห์ทางธุรกิจ ความปลอดภัย และการพัฒนาบริการ
  3. การปรับแต่งเนื้อหาและคำแนะนำ – ตามเงื่อนไขความยินยอมของผู้ใช้งาน
  4. การตรวจจับการฉ้อโกง ความปลอดภัยทางไซเบอร์ และการป้องกันการเข้าถึงที่ไม่ได้รับอนุญาต
  5. การปฏิบัติตามกฎหมายและข้อบังคับที่เกี่ยวข้อง
  6. การสื่อสารกับผู้ใช้งาน – เกี่ยวกับการอัปเดตบริการ การเปลี่ยนแปลงนโยบาย หรือประเด็นทางกฎหมาย
  7. การบังคับใช้ข้อกำหนดและเงื่อนไขของ EVOLT และการคุ้มครองสิทธิทางกฎหมายของบริษัท

3.2 ข้อจำกัดในการแบ่งปันข้อมูล

3.3 มาตรการรักษาความปลอดภัยและการควบคุมการเข้าถึง

Terms and Conditions

1. Definitions

For the purposes of these Terms and Conditions, the following definitions shall apply:

  1. “Account” means the individual user account required to access and utilize the Service.
  2. “Additional Terms” means additional terms and conditions which may apply to certain services, events, activities, or promotional programs, which will be disclosed to the user as applicable.
  3. “Application” means the EVOLT mobile application and website through which users may access and manage electric vehicle (EV) charging services.
  4. “Costs” means any fees, charges, or expenses that may be incurred by the User in connection with the use of the Service, including but not limited to charges for services rendered by third-party Service Providers.
  5. “Credit” means the monetary value added by a user to their application account, solely for the purpose of purchasing goods, services, or features offered within the application.
  6. “EVOLT” means EVOLT Technology Company Limited, a private limited company duly incorporated under the laws of the Kingdom of Thailand.
  7. “Service Providers” means third-party companies or individuals that may be engaged by EVOLT to perform certain functions or services on its behalf in connection with the provision, maintenance, improvement, or support of the Service.
  8. “Service” means the application, website, content, products, features, technologies, and any other services provided by EVOLT Technology Company Limited, whether currently available or developed and offered in the future.
  9. “User” means any natural or juristic person who accesses or uses the Service.

2. Relationship Relating to the Contract

These Terms and Conditions (“Terms”) govern access to and use of the application, website, content, products, features, technologies, and various services, both those currently available and those to be developed or provided in the future provided by Evolt Technology Company Limited, a private limited company incorporated under the laws of Thailand, with its principal office located at Block 28, Building C, 2nd Floor, Unit C201-202, Soi Chula 7, Wangmai, Pathumwan, Bangkok 10330, Thailand. These Terms apply to the user residing or operating within the jurisdiction of Thailand.

3. Acknowledgment and Acceptance of Terms

Please read these Terms carefully before accessing or using the Service. By accessing or using the Service, the user is deemed to have read, understood, and agreed to be bound by these Terms, thereby establishing a binding contractual relationship between the user and EVOLT. The user who do not agree to these Terms are expressly prohibited from accessing or using the Service.

These Terms may constitute the entire agreement or supplement any prior agreements between the user and EVOLT. EVOLT reserves the right, at its sole discretion, to terminate these Terms, suspend or discontinue the provision of the Service or any part thereof, or restrict the user’s access to the Service at any time and for any reason without prior notice.

Additional terms and conditions may apply to certain services, events, activities, or promotional programs, which will be disclosed to the user as applicable. In the event of a conflict between these Terms and any Additional Terms, the Additional Terms shall prevail concerning the specific service.
EVOLT reserves the right to amend or revise these Terms or any policies or Additional Terms from time to time. Such changes shall become effective upon publication. Continued access to or use of the Service after such publication constitutes the user’s acceptance of the revised Terms.

4. Services Provided

The Service includes the provision of electric vehicle (EV) charging stations and platform technology accessible via the EVOLT application or website. The user may use the Application to locate, schedule, and manage EV charging sessions, initiate and adjust charging services, process payments, including access to various features and services of the Application that may be developed or provided in the future.

4.1 License Grant

  1. Access and use the Application on a personal device solely for the purpose of utilizing the Service; and
  2. Access and use content, information, and related materials provided through the Service strictly for personal, non-commercial purposes.

All rights not expressly granted herein are reserved by EVOLT and its licensors.

4.2 Restrictions

  1. Remove any copyright, trademark, or intellectual property rights notices from any portion of the Service;
  2. Reproduce, modify, copy, adapt, distribute, license, lease, sell, transfer, publicly display, exhibit, publish, transmit, broadcast, or otherwise exploit the Service or any Content for public or commercial purposes, including in any form or manner substantially similar, unless expressly authorized by EVOLT;
  3. Decompile, reverse engineer, or disassemble the Service, except as permitted by applicable law;
  4. Link to, mirror, or frame any portion of the Service;
  5. Use any automated scripts, programs, or other means to extract, index, or otherwise gather data from any portion of the Service or interfere with the operation or performance of the Service;
  6. Attempt to gain unauthorized access to or impair any aspect of the Service, its related systems, or networks.

4.3 Use of EVOLT Branding

The User acknowledges that portions of the Service may be provided under the EVOLT brand or affiliated branding.

4.4 Proprietary Rights

All rights, title, and interest in and to the Service, including all intellectual property rights (including, but not limited to logos, trademarks, programs, or any software), shall remain the exclusive property of EVOLT or its licensors. These Terms do not grant the User any rights to:

  1. The Service itself, except for the limited license expressly provided herein; or
  2. Use or reference EVOLT’s name, logos, product and service names, trademarks, service marks, or any other indicia of ownership, except with prior written permission.

4.5 Booking Charging Stations

The users may locate and reserve charging stations through the Application, subject to station availability and time constraints. Each reservation may specify a time limit within which the user must commence charging, and any failure to initiate charging during this period may result in the automatic cancellation of the reservation. A fee may be imposed if the user cancels the reservation after the designated cutoff time or fails to comply with relevant cancellation policies communicated through the Application or other channels.

4.6 Feature-Specific Terms

Certain features within the Application may be subject to additional terms and operational conditions, including the following:

4.6.1 Charger Station Search

  1. Users may search for and view the locations of EV charging stations via the Application.
  2. Subject to the User’s consent, the Application may access the User’s location data to display nearby stations.
  3. Charging station information is subject to real-time updates. EVOLT does not warrant the accuracy, availability, or completeness of such data.

4.6.2 Receipts and Tax Invoices

  1. Following the completion of a transaction, Users may download a receipt via the Application.
  2. Users requesting a full tax invoice must provide required billing information, including company name, address, and taxpayer identification number.
  3. Tax invoices and receipts are issued in accordance with applicable Thai tax regulations. EVOLT shall not be liable for errors arising from inaccurate or incomplete user-provided information.

4.6.3 Notifications

  1. The Application may deliver notifications related to charging activity, transactions, and promotional offers to the User’s device.
  2. Users may manage notification settings within the Application.
  3. Notifications may be transmitted through third-party systems. EVOLT does not guarantee accuracy or timeliness of delivery.

4.6.4 Wallet Functionality

  1. Users may pre-load funds into a digital wallet within the Application for payment of services.
  2. Wallet balances are non-redeemable for cash, non-withdrawable, and non-transferable.
  3. The Application may provide a transaction history for the User’s reference.
  4. EVOLT reserves the right to modify wallet-related terms, including credit expiration periods and balance limits, without prior notice.

EVOLT may, at its discretion, update, modify, or discontinue features in the Application. Terms governing such features may be revised at any time without prior notice.

4.7 Data Handling and Privacy

4.7.1 Data Collection

  1. The Application may collect data regarding charging station searches and stations marked as favorites.
  2. Subject to user consent, location data may be used to display relevant station results.

4.7.2 Data Usage

  1. Collected data is used to present relevant results, improve service recommendations, and analyze user behavior.
  2. Data may also be used to enhance application functionality and improve operational efficiency.

4.7.3 Data Sharing

  1. Personal data shall not be disclosed to third parties without the User’s consent.
  2. Anonymized or aggregated data may be shared with EVOLT’s business partners for service enhancement purposes.

4.7.4 Data Security

  1. All collected data shall be securely stored and protected using industry-standard safeguards.
  2. Users may manage, access, or request deletion of their data through the Application’s privacy settings.

5. Use of Services by The User

5.1 The User Account Registration

To access and use all features of the Service, the user must register and maintain a personal account. The user must be at least 18 years of age or have reached the age of majority under Thai law. The user who does not meet this requirement must obtain the consent of a parent or legal guardian to register an Account.

During registration process, the user must provide accurate and current personal information, including but not limited to their name, address, telephone number, email, age, and a valid payment method (e.g., a credit card or another payment method accepted by EVOLT). The user agrees to keep their information accurate, complete, and up-to-date at all times. Failure to do so may result in the inability to access or use the Service, and EVOLT reserves the right to suspend or terminate the User’s Account without prior notice.

The User is solely responsible for all activities conducted under their Account and must keep their username and password secure and confidential. The user is prohibited from creating more than one Account unless express written consent is obtained from EVOLT.

5.2 Communications

By creating an Account, the user consents to receive service-related communications, including but not limited to text messages (SMS) and emails, from EVOLT as part of the normal business operations related to the user’s access and use of the Service.

5.3 Network and Device Access

The User is responsible for securing access to the necessary data network to use the Service. Data and messaging rates and fees from the user’s mobile or internet service provider may apply.

The User is also responsible for acquiring and maintaining compatible hardware or devices necessary to access and use the Application, including any required updates. EVOLT does not guarantee that the Service will function on any specific hardware or device, and the Service may be subject to malfunctions, delays, or other issues caused by internet connectivity or electronic communications systems.

6. Payment

6.1 Acknowledgment of Costs

The User acknowledges and agrees that the use of the Service may result in charges incurred for services provided by third-party service providers. Upon completion of the Service, EVOLT, acting as a limited payment collection agent on behalf of the service provider, will facilitate the payment of applicable Costs. Payment made through EVOLT shall be considered the same as payment made directly to the service provider.

Costs shall include any taxes required under applicable law and shall be immediately due in full upon completion of the Service. Unless otherwise specified, all payments are final and non-refundable, and refunds will generally not be issued in the event of user error, including but not limited to incorrect selections or improper use of the Service. EVOLT will facilitate payment using the payment method specified in the user’s Account. After processing the payment, EVOLT will issue a receipt to the user via email.

EVOLT reserves the right, at its sole discretion, to establish, modify, or adjust Costs for any services, products, or portions thereof available through the Service at any time. Such changes will be effective immediately upon posting or notification unless otherwise stated.

6.2 Payment Methods

Payment for charging sessions may be remitted via application wallet, credit or debit cards or through any online payment methods supported by the Application.

6.3 Charging Rates

Rates for charging sessions may vary based on factors including, but not limited to, the type of charging (AC/DC), the location of the charging station, and the duration of the charging session.

6.4 Wallet Top-Up

The user may securely top up their in-app wallet balance through the Web View interface within the Application. Supported top-up methods include Thai QR codes and credit cards.

6.5 Wallet Management

The user bears sole responsibility for managing their online wallet balance and ensuring the security of any stored credit card information within the Application. A monthly usage summary report for the preceding two years is accessible within the Application for the user reference.

6.6 Stored Credit

6.6.1 Scope of Stored Credit

  1. Credit once added shall not, under any circumstances, be redeemable for cash, withdrawn, or transferred to another user account.
  2. Credit is account-specific and may only be used within the account to which it was originally credited.

6.6.2 Adding Credit

  1. Users may top up Credit using payment methods supported by the application, which may include but are not limited to credit cards, debit cards, bank transfers, or other electronic payment channels as may be designated by the Company.
  2. All top-up transactions are final. Upon successful completion, Credit is non-refundable, non-convertible to cash, and non-transferable.

6.6.3 Use of Credit

  1. Credit may only be used within the application to purchase goods, services, or packages as designated by the Company.
  2. Credit that has been utilized shall not be refunded, except where such usage was the result of a system error or failure attributable to the application.
  3. Users are strictly prohibited from engaging in or attempting any form of Credit transfer between accounts. In the event of a violation, EVOLT reserves the right to suspend or terminate the user’s account, either temporarily or permanently.

6.6.4 Credit Expiration

  1. Credit may be subject to an expiration period as determined solely by the Company. Unused Credit after the expiration period shall be deemed forfeited and is not refundable.
  2. EVOLT reserves the right to modify the expiration period of Credit at any time without prior notice.

6.6.5 Reservation of Rights and Liability

  1. EVOLT reserves the right to cancel, modify, suspend, or terminate any user account in the event of misuse of Credit or breach of these Terms.
  2. EVOLT shall not be held liable for any loss, damage, or expenses arising out of or in connection with the misuse of Credit or unauthorized attempts to transfer Credit to another account.

7. Limitation of Liability

7.1 To the maximum extent permitted by applicable law, EVOLT shall not be liable for any damages of any kind, except where liability is expressly mandated by law. This includes, without limitation, any indirect, incidental, consequential, punitive, or exemplary damages, including but not limited to loss of profits, loss of data, damage to or loss of property, arising out of or in connection with the use or inability to use the Service, regardless of the cause, whether arising from negligence, force majeure, or any other circumstance beyond EVOLT’s reasonable control.

Notwithstanding the foregoing, the limitations set forth above shall not apply in the following circumstances:

  1. Death or personal injury caused by the proven negligence of EVOLT;
  2. Damages resulting from the willful misconduct or gross negligence of EVOLT; or

8. Law and Dispute Resolution

The use of the Service and the interpretation of these Terms shall be governed by and construed in accordance with the laws of the Kingdom of Thailand, without regard to conflict of law principles.

In the event of any dispute, controversy, or claim arising out of or relating to these Terms or the use of the Service, the parties shall attempt in good faith to resolve such dispute amicably. If the parties are unable to settle the dispute within thirty (30) days following the occurrence of the dispute, the dispute shall be submitted to arbitration in accordance with the arbitration rules of the Thai Arbitration Institute of the Ministry of Justice of Thailand (“TAI”), as applicable at the time the dispute is submitted.
